How to handle a disciplinary process…

Sounds like a boring topic for the OP Academy doesn’t it?!

Well, that’s where you would be wrong! This was probably one our most engaging topics on the OP Academy so far (attendees’ words, not mine 😉).

On 16th May at 5:30pm, we welcomed Darren Smith, Employment Partner of Herrington Carmichael Solicitors to host a session on the above topic at our very own offices in Bank and wow did he deliver. He captivated everyone in the room from the moment he started!

Darren’s wit, humour and naturally intriguing presentation took us on a journey on how to effectively carry out a disciplinary procedure using “juicy” case examples and excellent anecdotes from his time in employment law. The room bounced from quick fire questioning to loud laughter every minute.

First, we discussed the recent Sainsbury’s case in the news which sparked debate (excellent!), which then led us onto looking at ‘why is it important to get it right?’, ‘have you chosen the right reason?’, ‘are you/have you acted fairly?’ to then talking through the procedure using an example from the audience.

There were so many little tips and tricks to take away such as:

  • Start at ‘no suspension’ then work backwards.
  • When in the investigation stage always be thinking “what else can I find here?”
  • Set out your allegations VERY CLEARLY, it’s the simple things that could land you in so much bother if not done correctly during these processes.

The evening was filled with learning, debate, laughter, and many light bulb moments. Not to mention superb catch ups with our amazing OP Academy community!

Reading through the feedback, the word engaging is the main theme. The topic was a real hit and genuinely helped people to better their knowledge around something HR are faced with day in day out. Darren has kindly provided all information and slides so that we can pass onto those who attended, in case ever needed in the future – how awesome!!
